Certificates of Lawful Use
Speaker: Mike Hyde
 
Mike runs mh planning, based in Helensburgh.  He is a Chartered Town Planner with over 20 years experience of development planning, development management and enforcement. He has worked in Scotland and England and previous employers have included 2 National Park Authorities, a District Council and the private sector.
 
Certificates of Lawful Use can be use to establish immunity from enforcement action, or to determine whether development requiring planning permission will take place.  They can be of considerable benefit to both developers and Planning Authorities in situations where it is necessary to ascertain the lawful use of land.  This evening seminar will examine the effect and content of both Existing (S150) and Proposed (S151) Use Certificates and will give participants the opportunity to discuss:
  • when Certificates can and should be used;
  • the concept of  ‘lawfulness’;
  • time periods for ‘immunity’ – the 4 and 10 year rules;
  • the nature of the ‘evidence’ and the ‘balance of probability’ test;
  • what ‘substantial completion’ and a ‘single dwellinghouse’ are;
  • and the abandonment of uses of land and buildings.
